These Terms and Conditions govern your access to and use of the InstaFarms website, Android application, iOS application, mobile website, booking channels, customer support channels, and any related services provided by InstaFarms. For the purpose of these Terms and Conditions, “InstaFarms”, “we”, “us”, or “our” refers to InstaFarms (“VWA Hospitality Pvt Ltd”), the owner and operator of the InstaFarms brand. By accessing our website, using our mobile applications, making an enquiry, creating an account, or completing a booking through InstaFarms or any official booking channel, you agree to be bound by these Terms and Conditions, our Privacy Policy, Cancellation Policy, Refund Policy, and any other policies published by InstaFarms from time to time. If you do not agree with these Terms and Conditions, please do not use our website, mobile applications, booking channels, or services. InstaFarms may update, modify, or replace these Terms and Conditions at any time. Updated Terms and Conditions will be effective from the date they are published on our website or application. You are advised to review this page periodically. 1. Scope of Services InstaFarms provides an online and offline platform for discovering, enquiring, and booking farmhouses, villas, bungalows, homestays, private stays, event-friendly properties, and similar accommodation or stay experiences. Bookings may be made through: - InstaFarms website - InstaFarms Android app - InstaFarms iOS app - Mobile website - Customer support team - WhatsApp or call-based booking assistance - Third-party platforms - Travel agents - Advertisements - Referrals - Any other official or authorized booking channel Together, these are referred to as “Booking Channels”. 2. Definitions For the purpose of these Terms and Conditions: Property / Properties means farmhouses, villas, bungalows, homestays, private stays, event-friendly properties, or any other accommodation listed or made available through InstaFarms. Guest / Guests / You / Your means any individual, company, group, or entity that accesses InstaFarms, makes an enquiry, or books a Property through any Booking Channel. Booking means a reservation made by a Guest for a Property for accommodation, stay, event, gathering, or related permitted purpose. Check-In means the date and time from which the Guest is allowed to enter and use the booked Property, subject to completion of all required formalities. Check-Out means the date and time by which the Guest must vacate the Property after completing all required formalities. Booking Period means the duration between the scheduled Check-In and scheduled Check-Out. Booking Amount means the total amount payable by the Guest to confirm and complete the Booking. Advance means the amount paid by the Guest to initiate, block, hold, or confirm a Booking. Unless specifically mentioned otherwise, the Advance may be non-refundable as per the applicable Cancellation Policy. Security Deposit means an amount collected from the Guest, where applicable, to cover damages, extra charges, rule violations, cleaning charges, pet-related damages, or any other recoverable amount. Booking Confirmation means the confirmation shared by InstaFarms with the Guest after receipt of required payment, containing booking details such as Property name, Guest details, Check-In and Check-Out dates, Booking Amount, Security Deposit, payment status, house rules, and other relevant details. Peak Days means high-demand dates including weekends, long weekends, public holidays, festive periods, Christmas, New Year, Diwali, special event dates, and any other dates notified by InstaFarms. 3. Eligibility You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872 to use InstaFarms and make a Booking. Persons below 18 years of age are not permitted to make Bookings independently. Minors may stay at a Property only when accompanied by a parent, legal guardian, or responsible adult. By using InstaFarms or making a Booking, you confirm that you are legally eligible to do so. 4. User Account and OTP Login InstaFarms may allow users to access services through mobile number verification, OTP login, email login, or any other authentication method. You are responsible for maintaining the confidentiality of your account, mobile number, OTPs, devices, and login access. You agree not to share your OTP or account access with any unauthorized person. InstaFarms will not be responsible for any loss or damage arising from unauthorized access caused by your failure to protect your login credentials or OTP. 5. Accuracy of Information You agree to provide true, accurate, complete, and updated information while using InstaFarms or making a Booking. This includes your name, mobile number, email address, Guest details, identity details, booking dates, number of Guests, payment details, and any other information required by InstaFarms. InstaFarms will not be responsible for failed bookings, incorrect communication, refund delays, denial of check-in, or any other issue caused by incorrect, incomplete, false, or outdated information provided by you. 6. Booking Process A Booking may be initiated through any Booking Channel. A Booking will be treated as confirmed only when InstaFarms receives the required payment as communicated to the Guest and issues a Booking Confirmation. Payment of only an Advance, partial amount, or Security Deposit does not always guarantee final confirmation unless specifically confirmed by InstaFarms. InstaFarms is not obligated to provide access to the Property unless the full Booking Amount and any applicable charges are paid within the timeline communicated by InstaFarms. If the required payment is not received within the specified time, InstaFarms may cancel the Booking or release the Property for other Guests. 7. Booking Confirmation After receiving the required payment, InstaFarms may issue a Booking Confirmation through email, SMS, WhatsApp, app notification, website account, or any other official communication channel. The Booking Confirmation may include: - Property name - Check-In and Check-Out date and time - Guest name - Number of Guests - Booking Amount - Payment status - Security Deposit, if applicable - House rules - Cancellation terms - Additional charges, if any - Property-specific instructions - Contact details or check-in instructions Guests must carry or show the Booking Confirmation and valid payment proof at the time of Check-In if requested. 8. Bookings Through Third Parties If a Booking is made through a third-party website, application, travel agent, advertisement, referral partner, or any other third-party channel, the Guest must ensure that the Booking is confirmed by InstaFarms. InstaFarms will not be obligated to honor any Booking unless the Booking is verified and confirmed by InstaFarms and the required payment is received. Third-party terms may also apply to such Bookings. However, in case of conflict between third-party terms and InstaFarms Terms and Conditions, InstaFarms Terms and Conditions will prevail to the maximum extent permitted by law. 9. Pricing and Tariffs Property prices, tariffs, packages, taxes, fees, and charges displayed on InstaFarms or communicated through any Booking Channel may change without prior notice. Prices may vary based on: - Property type - Date of booking - Weekdays or weekends - Peak Days - Guest count - Event type - Duration of stay - Demand and availability - Additional services - Offers or discounts - Taxes and applicable charges InstaFarms reserves the right to correct any pricing error, technical error, typographical error, or incorrect tariff displayed on any Booking Channel. An incorrect price displayed due to a technical glitch or human error shall not be binding on InstaFarms. 10. Taxes and Additional Charges The Booking Amount may or may not include applicable taxes depending on the Property, package, booking type, or invoice structure. Additional charges may apply for: - Extra Guests - Early Check-In - Late Check-Out - Pets - Cleaning - Damages - Security - Events or parties - Food services - Chef services - Barbecue setup - Decoration - Vehicle hire - Additional rooms - Additional bedding - Electricity or utility overuse, where applicable - Any other service requested by the Guest Such charges must be paid by the Guest as communicated by InstaFarms. 11. Payment Terms Guests must make payments only through payment methods approved or communicated by InstaFarms. Accepted payment methods may include: - Credit card - Debit card - UPI - Net banking - Wallets - Bank transfer - Payment gateway links - Other approved payment methods InstaFarms may use third-party payment gateways or payment service providers to process payments. Any payment gateway charges, bank charges, transaction fees, convenience fees, or payment failure issues charged by third-party providers are independent of InstaFarms unless specifically stated otherwise. If payment is not completed successfully, InstaFarms will not be obligated to confirm or serve the Booking. 12. Financial Details You confirm that any card, UPI ID, bank account, wallet, or financial instrument used by you for payment is legally owned or authorized for use by you. You agree not to use any stolen, unauthorized, fraudulent, or unlawfully obtained payment method. InstaFarms will not be responsible for any fraud, unauthorized payment, chargeback, or misuse of financial instruments by you or any third party. 13. Check-In and Check-Out Check-In and Check-Out timings will be mentioned in the Booking Confirmation or communicated by InstaFarms. Guests are advised not to arrive before the scheduled Check-In time unless early Check-In has been approved in writing by InstaFarms. Early Check-In and late Check-Out are subject to availability and may attract additional charges. Guests must vacate the Property by the scheduled Check-Out time. Failure to vacate on time may result in additional charges, deduction from Security Deposit, or other action as deemed appropriate by InstaFarms. 14. Right of Admission InstaFarms and/or the Property owner, host, caretaker, or manager reserves the right to deny admission or cancel access to the Property if: - Required payment has not been completed - Booking Confirmation is not available or valid - Guest identity verification fails - Guest provides false or misleading information - Guest count exceeds the approved number - Guest violates house rules - Guest appears intoxicated, aggressive, unsafe, or disruptive - Guest is suspected of unlawful activity - Guest refuses to provide required documents - Guest attempts to bring unauthorized pets, visitors, or additional Guests - Any other reasonable safety, legal, operational, or property-related concern arises In such cases, InstaFarms may cancel the Booking without refund, depending on the circumstances. 15. Identity Verification and Guest Register All Guests may be required to provide valid government-issued photo identification before or at the time of Check-In. Accepted IDs may include Aadhaar Card, Passport, Driving License, Voter ID, or any other government-issued identity document accepted by InstaFarms or required by law. Guests may be required to enter their names, addresses, ID details, and other required information in a physical or digital Guest Register. Failure to provide valid identification may result in denial of Check-In without refund. 16. Guest Count and Visitors The total number of Guests, including visitors, must not exceed the number approved at the time of Booking. Additional Guests or visitors may be allowed only with prior written approval from InstaFarms and may attract additional charges. Unauthorized Guests or visitors may result in cancellation of the Booking, eviction from the Property, forfeiture of payments, deduction from Security Deposit, or additional charges. 17. Use of Property The Property must be used only for the purpose approved at the time of Booking. Unless specifically approved by InstaFarms in writing, the Property must not be used for: - Commercial activities - Ticketed events - Public gatherings - Illegal activities - Rave parties - Drug use - Gambling - Prostitution - Filming or photography for commercial use - Political events - Activities causing nuisance to neighbors - Any activity prohibited by law or property rules Guests do not receive possession, tenancy, leasehold rights, ownership rights, or any similar rights over the Property. A Booking only provides temporary permission to use the Property for the approved Booking Period and approved purpose. 18. House Rules and Guest Conduct Guests must follow all house rules communicated by InstaFarms, the Property owner, caretaker, host, or manager. Guests must: - Maintain cleanliness - Respect neighbors and local community - Avoid loud music in outdoor areas - Avoid nuisance or disturbance - Use the Property and amenities responsibly - Follow swimming pool rules, where applicable - Follow parking rules - Avoid damage to furniture, appliances, décor, plants, equipment, and fixtures - Follow safety instructions - Cooperate with caretakers and property staff - Comply with applicable laws InstaFarms may take action against Guests who violate house rules, including eviction without refund. 19. Noise, Music, and Events Guests must ensure that music, celebrations, events, or gatherings do not disturb neighbors, nearby residents, local authorities, or other persons. Outdoor loud music, DJ systems, speakers, poolside music, terrace music, or late-night disturbance may be restricted or prohibited depending on Property rules and local regulations. InstaFarms may ask Guests to reduce noise or stop activities that cause disturbance. Failure to comply may result in eviction, police complaint, penalty, or forfeiture of payments. 20. Prohibited Activities Guests must not engage in or permit any unlawful, unsafe, immoral, or prohibited activity at the Property. Strictly prohibited activities include: - Possession or consumption of illegal drugs - Rave parties - Gambling, unless legally permitted - Violence or threats - Harassment - Damage to property - Theft - Public nuisance - Unauthorized commercial activity - Carrying illegal weapons - Activities violating local laws - Misbehavior with staff, caretakers, neighbors, or authorities If any prohibited activity is found, InstaFarms may cancel the Booking, evict the Guests, forfeit payments, inform authorities, and take legal action. 21. Safety and Personal Responsibility Guests are responsible for their own safety and the safety of other members of their group during the stay. Guests must take care while using: - Swimming pools - Open areas - Staircases - Terraces - Balconies - Gardens - Electrical appliances - Kitchen equipment - Barbecue equipment - Outdoor spaces - Any other amenities or facilities InstaFarms will not be responsible for accidents, injuries, illness, loss, death, damage, or any incident caused due to Guest negligence, unsafe behavior, intoxication, misuse of amenities, violation of rules, or failure to follow safety instructions. 22. Children and Minors Children and minors must be supervised by responsible adults at all times. Guests are fully responsible for the safety, conduct, and actions of children accompanying them. InstaFarms will not be responsible for any injury, accident, or loss involving minors due to lack of supervision or misuse of Property facilities. 23. Pets Policy Pets may be allowed only at selected Properties and only with prior written approval from InstaFarms. If pets are allowed, additional pet fees, cleaning charges, or security deposits may apply. Guests must ensure that pets: - Remain under control and supervision - Do not damage the Property - Do not soil furniture, bedding, pool areas, or indoor spaces - Do not enter restricted areas - Do not disturb neighbors, staff, or other persons - Do not enter swimming pools unless specifically allowed - Are cleaned up after by the Guest Unauthorized pets may be denied entry. If unauthorized pets are brought to the Property, InstaFarms may cancel the Booking, evict the Guests, levy charges, or deduct amounts from the Security Deposit. 24. Security Deposit and Damages InstaFarms may collect a Security Deposit before or during Check-In. The Security Deposit may be used to recover costs related to: - Damage to Property - Damage to furniture, appliances, décor, equipment, pool, garden, or fixtures - Missing items - Excess cleaning - Rule violations - Unauthorized Guests - Unauthorized pets - Late Check-Out - Noise complaints - Utility misuse - Penalties or charges imposed due to Guest conduct - Any other recoverable amount Guests must inspect the Property at Check-In and report any existing damage or issue to InstaFarms or the caretaker within 90 minutes of Check-In, along with photos or videos where possible. If no issue is reported within this time, any damage found later may be treated as having occurred during the Guest’s stay. The Property may be inspected after Check-Out. If damage or loss is found, the cost of repair, replacement, cleaning, or penalty may be deducted from the Security Deposit. If the damage amount exceeds the Security Deposit, the Guest must pay the additional amount within the timeline communicated by InstaFarms. Security Deposit refund, after applicable deductions, will be processed within the timeline communicated by InstaFarms, subject to inspection, bank/payment processing time, and resolution of any dispute. 25. Additional Services InstaFarms may help arrange additional services on request, subject to availability. Such services may include: - Food packages - Chef - Barbecue - Decoration - Cleaning - Vehicle hire - Event setup - Bonfire - Extra bedding - Photography - Other third-party services Additional services may be provided by third-party vendors and may not be included in the Booking Amount. InstaFarms may assist in coordinating these services for Guest convenience but does not guarantee availability, quality, timing, or performance of third-party vendors unless specifically stated. Additional service charges must be paid by the Guest. 26. Property Amenities and Availability InstaFarms makes reasonable efforts to display accurate information about Properties, amenities, photos, availability, and pricing. However, Guests acknowledge that certain amenities may be unavailable due to maintenance, weather, power issues, local restrictions, technical issues, vendor issues, or other circumstances. Amenities may include swimming pool, WiFi, air conditioning, kitchen appliances, power backup, games, lawns, music systems, or other facilities. Temporary unavailability of any amenity does not automatically entitle the Guest to a refund or compensation. 27. Accuracy of Content and Property Information InstaFarms attempts to ensure that all content, photos, descriptions, prices, and Property details displayed on its website, app, or Booking Channels are accurate. However, minor differences may exist between photos and actual Property condition, décor, furniture, layout, surroundings, or amenities. InstaFarms will not be liable for minor variations, typographical errors, technical errors, or outdated information unless there is a material mismatch that significantly affects the Booking. 28. Guest Issues During Stay If the Guest faces any issue during the stay, including cleanliness, amenity failure, electricity, water, WiFi, pool, appliance issue, insects, odor, staff issue, or any other concern, the Guest must report it to InstaFarms or the caretaker as soon as possible. Guests should preferably report issues within 12 hours of Check-In or immediately after discovering the issue, along with photos, videos, or other evidence where possible. InstaFarms will make reasonable efforts to resolve reported issues. However, InstaFarms does not guarantee immediate resolution in every case and will not be liable for refunds or compensation for issues beyond its reasonable control. No claim will be considered valid if the issue was not reported during the stay and is raised only after Check-Out. 29. Cancellation and Refunds Cancellations and refunds will be governed by the Cancellation Policy and Refund Policy published by InstaFarms. Guests are advised to read the Cancellation Policy carefully before making a Booking. InstaFarms may cancel a Booking due to non-payment, rule violation, safety concerns, force majeure, Property unavailability, fraud suspicion, technical error, or any other valid reason. Refund eligibility, refund amount, deductions, and refund timelines will be determined as per the applicable policy and booking terms. 30. Offers, Discounts, and Promotions InstaFarms may provide promotional offers, coupons, discounts, referral benefits, wallet benefits, or special pricing from time to time. Such offers may be subject to specific terms including validity period, minimum booking value, applicable dates, selected Properties, user eligibility, platform restrictions, and cancellation rules. InstaFarms reserves the right to modify, withdraw, reject, or cancel any offer at any time without prior notice. Offers cannot be claimed as a matter of right. 31. Communication Consent By providing your contact details or using InstaFarms, you agree that InstaFarms may contact you through: - Phone call - SMS - WhatsApp - Email - Push notification - In-app notification - Other communication channels Communication may relate to bookings, enquiries, payments, refunds, support, offers, reminders, updates, feedback, or service information. You may opt out of promotional communication where such option is available. However, transactional and service-related communication may still be sent. 32. Privacy and Personal Data Your personal information will be collected, used, stored, and shared in accordance with our Privacy Policy. By using InstaFarms or making a Booking, you agree to the collection and use of your information as described in our Privacy Policy. 33. Third-Party Links and Services The InstaFarms website or app may contain links to third-party websites, payment gateways, map services, social media platforms, or external tools. InstaFarms is not responsible for the content, security, policies, practices, or availability of third-party websites or services. Your use of third-party services is subject to their own terms and privacy policies. 34. Intellectual Property Rights All content, branding, logos, names, designs, text, graphics, images, videos, software, layouts, icons, trademarks, service marks, domain names, and other materials available on InstaFarms are owned by or licensed to InstaFarms. You must not copy, reproduce, scrape, modify, publish, distribute, sell, exploit, or misuse any InstaFarms content or intellectual property without prior written permission. Unauthorized use of InstaFarms intellectual property may result in legal action. 35. Website and App Usage Restrictions You agree not to: - Interfere with the functioning of the website or app - Attempt unauthorized access to systems or data - Use bots, scrapers, crawlers, or automated tools without permission - Upload viruses, malware, or harmful code - Copy or misuse content - Attempt fraud or false booking - Misrepresent identity - Violate applicable laws - Use InstaFarms for unlawful purposes InstaFarms may suspend or terminate access if misuse is detected. 36. Limitation of Liability To the maximum extent permitted by law, InstaFarms will not be liable for: - Accidents, injuries, illness, death, or personal loss during stay - Guest negligence or misconduct - Illegal activities by Guests - Loss of personal belongings - Theft or damage caused by third parties - Property-related issues beyond reasonable control - Temporary unavailability of amenities - Power, water, internet, weather, or local authority issues - Actions of third-party vendors - Payment gateway failures - Technical errors or downtime - Indirect, incidental, special, or consequential losses If InstaFarms is found liable for any claim, its liability shall be limited to the Booking Amount paid by the Guest for the relevant Booking, unless otherwise required by law. 37. Indemnification You agree to indemnify and hold harmless InstaFarms, its owners, directors, employees, partners, affiliates, representatives, agents, vendors, and service providers from any claims, losses, damages, liabilities, penalties, costs, or expenses arising from: - Your misuse of InstaFarms services - Your breach of these Terms and Conditions - Your violation of law - Your misconduct at the Property - Damage caused by you or your group - Unauthorized activities - Claims by third parties due to your actions - False information provided by you 38. Force Majeure InstaFarms will not be liable for any failure, delay, cancellation, loss, or damage caused by events beyond its reasonable control. Force Majeure events may include: - Natural disasters - Fire - Flood - Storm - Earthquake - Pandemic or epidemic - Government restrictions - Lockdowns - War - Riots - Civil disturbance - Strikes - Transport disruption - Utility failure - Internet failure - Machinery breakdown - Local authority action - Legal or regulatory restrictions - Any other event beyond reasonable control In such cases, InstaFarms may modify, reschedule, cancel, or make alternative arrangements at its discretion. 39. Termination or Suspension InstaFarms reserves the right to suspend or terminate your account, Booking, access, or use of services if: - You violate these Terms and Conditions - You misuse the platform - You provide false information - You engage in fraudulent activity - You violate Property rules - You behave unsafely or unlawfully - You cause damage or nuisance - Required payment is not completed - Any legal, safety, or operational concern arises Termination may happen without prior notice depending on the seriousness of the issue. 40. Assignment Bookings made by Guests are non-transferable unless specifically approved in writing by InstaFarms. You may not assign or transfer your rights or obligations under these Terms without prior written consent from InstaFarms. InstaFarms may assign or transfer its rights and obligations to any affiliate, successor, buyer, or business entity as part of restructuring, merger, acquisition, or transfer of business. 41. Notices InstaFarms may send notices, updates, booking communication, policy changes, or other communication through email, SMS, WhatsApp, app notification, website notification, or any other contact details provided by you. Notices sent electronically shall be considered received once sent by InstaFarms. 42. Feedback and Submissions If you submit feedback, suggestions, ideas, reviews, images, videos, comments, or other materials to InstaFarms, you grant InstaFarms the right to use, publish, reproduce, modify, display, and share such materials for service improvement, marketing, promotional, operational, or business purposes, unless restricted by applicable law. You confirm that your submissions do not infringe the rights of any third party. 43. Dispute Resolution, Arbitration, and Jurisdiction Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions, any Booking, use of InstaFarms services, or any related matter shall first be attempted to be resolved amicably between the parties. If the dispute is not resolved amicably, it shall be referred to arbitration by a sole arbitrator mutually appointed by the parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time. The seat and venue of arbitration shall be Hyderabad, Telangana, India. The arbitration proceedings shall be conducted in English. Subject to arbitration, the courts of Hyderabad, Telangana, India shall have exclusive jurisdiction. 45. Governing Law These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. 46. Waiver Failure by InstaFarms to enforce any right or provision under these Terms and Conditions shall not be considered a waiver of such right or provision. 47. Severability If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to remain valid and enforceable. 48. Entire Agreement These Terms and Conditions, along with the Privacy Policy, Cancellation Policy, Refund Policy, and any other applicable policies published by InstaFarms, constitute the entire agreement between you and InstaFarms regarding your use of the services and Bookings. 49.
